Terms and Conditions Governing the Provision of Our Services

The following Terms and Conditions (“Terms”) pertain to the use of this website and the sale of services by Inquisitive, LLC (“INQUISITIVE”) to the customer (“Customer”). By accessing this site or purchasing services from INQUISITIVE, the Customer consents to be bound by these Terms. The Terms act as the entire agreement between INQUISITIVE and the Customer with respect to its subject matter, superseding any prior negotiations and agreements. The Terms may not be changed in any respect except by the posting of revised or amended terms by INQUISITIVE on this site. Should the Terms be changed at any time, the provisions governing a particular project shall be those that were in force at the time of the Customer’s payment for that project. All revisions to these policies shall be published to the website and become binding upon all new projects immediately.

Limited License and Website Use

INQUISITIVE grants the Customer a limited, non-exclusive and non-transferable license to access and make personal use of this website. The Customer agrees not to download (other than page caching) or modify any portion of this website, except with the express written consent of the INQUISITIVE. This license is nonexclusive and does not include any (i) resale or commercial use of this website or its contents; (ii) collection and use of any product or service listings, descriptions, or prices; (iii) derivative use of this website or its contents; (iv) downloading or copying of account information for the benefit of another merchant; or (v) any use of data mining or similar data gathering and extraction tools. This website or any portion thereof may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose without the express written consent of INQUISITIVE.

Refund Policy, Limited Warranty and Guarantee

Orders placed with INQUISITIVE by the Customer can not be cancelled and are non-returnable. They are covered by a limited warranty (see Warranty Disclaimer, below). If Customer is not satisfied with INQUISITIVE’s service for a particular order, the Customer shall contact INQUISITIVE within thirty (30) days of delivery of the service and shall provide details of their complaint. Upon verification of the problem, INQUISITIVE guarantees that it shall solve the problem to the Customer’s satisfaction or either provide credit for additional service to the Customer or refund the fee paid for the service in question, based upon the Customer’s preference.

Revision Policy

The Unlimited Revisions policy is a courtesy service that is provided by INQUISITIVE to the Customer. If a Customer requires the revision of an order the Customer shall contact INQUISITIVE within fourteen (14) days of delivery of such service and provide details of their revision requirements. Revision requests are invalid if they constitute a significant deviation from the original specification of the order. Once a period of fourteen (14) days has lapsed it shall be assumed that the Customer is satisfied with the order and no further revisions may be requested.

Disclaimer of Warranties and Limitation on Liability

(a) INQUISITIVE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. INQUISITIVE PROVIDES A LIMITED EXPRESS WARRANTY THAT ITS SERVICES SHALL BE PERFORMED IN A MANNER SATISFACTORY TO ITS CUSTOMERS. OTHERWISE, INQUISITIVE MAKES NO REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, SERVICES, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. CUSTOMERS AGREE THAT THE USE OF THIS SITE IS AT THEIR SOLE RISK.

(b) IN NO EVENT WILL INQUISITIVE BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF USE, LOSS OF DATA OR BUSINESS INTERRUPTION, RESULTING FROM THE PERFORMANCE OF INQUISITIVE’S SERVICES, THE USE OR INABILITY TO USE INQUISITIVE ‘S WEBSITE, THE MATERIAL CONTAINED ON THIS WEBSITE, OR ANY BREACH OF INQUISITIVE’S OBLIGATIONS HEREUNDER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OPERATION OF LAW, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT INQUISITIVE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL INQUISITIVE ‘S LIABILITY FOR DAMAGES HEREUNDER EXCEED THE AMOUNT OF THE FEES PAID BY A CUSTOMER FOR THE SERVICES IN QUESTION.

(c) While INQUISITIVE tries to ensure that any files originating at this website are free of known computer viruses, INQUISITIVE makes no warranty or guarantee that files are virus free, and INQUISITIVE is not able to provide any assurances with respect to e-mail or attachments which may have originated with third parties. This website may provide links to Internet sites maintained by third parties. INQUISITIVE does not operate or control in any respect any information, products or services on these third-party websites and assumes no responsibility for the contents of said websites. INQUISITIVE is not liable or responsible for any damage to computer hardware or software arising from the distribution of a computer virus through the use of this website. INQUISITIVE is not liable or responsible for service delays resulting from unforeseen circumstances such as technical problems.

Electronic Communications

When you visit this website, send e-mails to INQUISITIVE, upload documents to this website, or download documents from this website you are communicating with INQUISITIVE electronically. You agree that all agreements, notices, disclosures and other communications that INQUISITIVE provides to you and that you provide to INQUISITIVE electronically satisfy any legal requirement that such communications be in writing.

Indemnification

The Customer agrees to defend INQUISITIVE at the Customer’s cost and expense, and will indemnify and hold INQUISITIVE and its respective officers and agents (the “INQUISITIVE Indemnified Parties”) harmless from and against any losses, costs, damages, fees or expenses arising out of any claim relating to the use or application of INQUISITIVE’s services by Customer.

Delivery

The Customer acknowledges that INQUISITIVE will not be held liable or responsible for any type of delivery issues that arise from problems such as spam filters, incorrect email, lack of Internet access or general neglect. The provision of correct contact information and regular consultation of emails is the sole responsibility of the customer.

Confidentiality and the Protection of Customers’ Intellectual Property

At all times the documents submitted by the Customer to INQUISITIVE, or created for the Customer by INQUISITIVE, are to remain the sole and exclusive intellectual property of the Customer. INQUISITIVE shall not lay claim to legal ownership of these materials, in whole or in part, whether created by the Customer or by INQUISITIVE on behalf of the Customer.

Refusal and Termination of Services

INQUISITIVE reserves the right to refuse service to any Customer. Such refusal may include, but is not limited to, projects involving materials that INQUISITIVE determines to be violent, obscene, or offensive; to advocate violent or illegal activity; to contain (or have the potential to contain) any computer viruses; or to contravene any law, statute, or ordinance.

Applicable Law and Venue

This site (excluding linked sites) is controlled by INQUISITIVE, which is headquartered in the State of Georgia, United States of America. The site can be accessed from all 50 states and the District of Columbia, as well as from other countries around the world. As each of these places has laws that may differ from those of Georgia, by accessing this site, both the Customer and INQUISITIVE agree that the statutes and laws of the State of Georgia, without regard to conflicts of laws and principles thereof, will apply to all matters arising from or relating to use of this site. The Customer and INQUISITIVE also agree and hereby submit to the exclusive personal jurisdiction and venue of the federal district and state courts of Georgia with respect to such matters. INQUISITIVE makes no representation that materials on the site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who choose to use or access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
